Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. What this means is that any person charged under the new law is entitled to a taxpayer funded public defender or taxpayer funded private lawyer. And we lawyers...

Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers. And then he somehow has to seem reasonable on the issue by the time he gets to the November election. The Miami Herald reports on how this is going to be a tough task.

What happens when a person takes a leave of absence and is out of the country? 140 is approved and I 485 is pending? Technically employed but not getting paid. My cousin is considering this as a possibility and is being overwhelmed with responsibilities in India. He was a July 07 filer, and his pd is Apr 02

if filed I think your att. may use PD portability.
If not filed, don't see any reason why he can't straight use the LC of 2003.

My husband's labor was filed in the end of June, no response yet. It was much faster for me in 2006. I would also like to know if anyone got a response.

Guys, Assuming that everyone from July Filers group went through FP for AOS once at that time, do they need to go again to get the AOS approved now? My question is ppl who r being approved these days and if they r july filers, did they go for 2nd FP? Can uscis use FP of EAD in 485 ?

My priority date is Jan 04 which was current in June this year. My stupid lawyer sent the whole package of I485 and I765 for me and wife to Chicago address (for family based cases) instead of the Nebraska address where employment based cases are supposed to be sent. The package was mailed around 15th June. I started getting worried since my checks haven't been cashed today so I called the National customer center where they told me about this goof up and said they mailed the package back to the lawyer, last Tuesday.
I don't know if there is anything that can be done at this point to salvage the situation since, with the July bulletin fiasco everything is unavailable now. Really appreciate if any one knowledgeable can comment...any help really

My H1B expired when I renewed (last month) my EAD. I e-filed it and selected H1B "SPECIALITY OCCUPATION". I got my new EAD card in hand within 22days from the day I filed.

I am applying for an H-1B extension. The prevailing wage determined by icert is less than my actual salary by about $30,000. Will there be a problem if my salary is much higher than the prevailing wage?
