I applied to VSC on Sept 17,2008 and still waiting. USCIS website as of Aug 31,2008 saying processing application as @ Jan 15,2008. Does not know how long the wait can be.

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.
If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?

22 Democratic Senators are urging President Obama to stop deporting young people who are likely to be eligible for legalization if the DREAM Act passes. The White House has so far rebuffed such requests with the not very believable excuse that it's hands are tied. That's simply not so and the President's executive authority to solve immigration problems Congress is ignoring has been well documented. Hopefully, the pressure will start to pay off.

I'm going to India and is planning to get my h1 visa stamped...
How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...
I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..
Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...
Can someone pls advise me on this?

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

Hello - I just recd. the TRANSFER NOTICE for me & my wife's 485 case stating that the case has been transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. We had filed for AOS in July 2007 and my priority date for is April 2006 (EB-2).
I would appreciate it if somebody can please shed some light on what this means for us. What are the implications for us.? Will the case be transferred to the local office.? Should i start to gather documents for a interview.
Would appreciate any advice i can get. Thank you!

Folks,
Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

If your 'temp stay' implies staying in a hotel and flying to Chicago on the weekend then no. If it means that you have leased an apartment and plan to stay in NY for a few months then sure go ahead and fill it out.

Hi,
Im having my H1B and 140 approved with my current employer. Now I got into a situation where in I need to file a new H1B with a new employer through whom im working on a project.But once my H1B is approved, my new employer will dismiss/cancel the new H1b Filed, as they just need to show that they filed a H1B for me.
Will this be a problem for my current 140 and GC processing or my existing H1B?
Coz that Im not going to use my new H1B, I can still continue using my current I94 right!
Any issues if my new H1b gets rejectd or queried!

Though I have started only one theread in last three years of my membership, I can't resist a temptation to start one now. From the following article in WSJ the lame duck session now appears certain and it is going to be in this month !!!!!!!!!!!!
The link does not require user ID and passowrd. I am late on sending my e-mails on housing crisis and emplyment based green cards. But I am going to do it right now. I urge all the members to do the same. Though I am not sure whther they will take up HR 5882 or any other relief language, no harm in hoping and praying.

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.
Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.
Please suggest me the best possible way ...

The Los Angeles City Council has approved a measure barring city workers for traveling to Arizona on official business and also banning the city from contracting with Arizona businesses. Some contracts for key infrastructure items are not affected, but the LA Times estimates that the vote will cost Arizona upwards of $8 million per year. The biggest contracts not affected are those involving the airport and sea port. But the civilian panels overseeing them are considering canceling contracts worth $26 million. On Monday, Boulder, Colorado will vote on a similar measure. San Jose votes next month.
