Hi for IRS n Tax purposes you are a resident alien (even though you may be a non-immigrant h1b or using EAD) that is different.
This form is not applicable to you. Tell the credit union that you are resident alien and then they will understand.
No need to fill this form.
Instead you need to apply for TIN (Tax Payer Identification Number) Form W-9 for your wife and get a TIN and use that TIN while adding as a dependent.
You can either file the TIN yourself or go to HnR block or some other service. Usually they file for TIN while filing tax return...

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

HI!! I'm Aj ( more like Ahmet Jorayev). I was a student at the Georgia Military College. Unfortunately, due to lack of my personal funds, i lost my position of a student at GMC. Since January of this year i was not attending school because of exclusion. College informed of returning in Spring 2010 however they denied it later on. Currently I'm in deep depression because of losing my Academic and Immigration Status!!
IN order to reinstate I-20 visa i had to attend college. Sarcastic thing about this i had only 6month left to graduate.
Any advises or stories you can share please, help out!!
They have our future in their hands and instead of supporting,they disgrace us!!

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?

Hi All,
How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I've just received an RFE for my I-485. I am feeling incredibly disheartened because I thought I'd done everything right and I am struggling not being able to work or travel... I have a seriously ill family member back home, and my husband and I have an understanding that if anything happens I'm getting on the plane no matter what. I'm just praying I get my AP soon so the "no matter what" doesn't have to mean abandoning our home and life here in the US.

I had applied for GC through my husband s employer for EB1 category. Recently USCIS websites has updated on its site regarding our case that I485 has been approved but I765 has been denied. Currently we are on L1/L2 visa. Has anyone faced such a situation? And what does this signify?

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.
Are you serious? Wait until your date become current and until then do not do anything. Instead of looking for ways to withdraw your I-485, why dont you look for ways to find a job that matches your I-140 skills, so that you can use AC21 portability.
You will never know when will you get your chance to file 485 again if you withdrew it.

I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
