USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

only for 2 months. You should ask a friend to monitor your mail. Sometimes USCIS just sends FP requests out of the blue. At least you will be able to call and reschedule the FP.

Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.

I came to US last December to visit my family by a tourist visa. during the time that I was here I got a letter that showed I won DV lottery. so I hired a lawyer and he told me he will be able to apply for me from here. so he prepared our file before our visa expiration date and sent our file. but we got rejection notice and he said this is because of sending it early. he did the same 3 times but each time we got the same rejection notice. now he says that we are out of status and our case is dismissed!! As i checked USCIS office, we were not able to send it before November according to our case number. now I want to know what should I do? is it really over?

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
Any other requirements from the employer?

The employer has to be big enough (300+ is a big company) or if small (such as less than 15), it has to show company's return and sometimes business in hand.

Just hours after the announcement that DHS will seek to rescind the controversial social security no-match rule, the Senate may consider an amendment to the DHS spending bill that has been introduced by Senator David Vitter (R-LA). Consider a consultant-only company where all employee work on client projects and all got EAD and can change employer anytime they want. What happens if everyone leave the company after 180 days and you (and few other) still continue. As this will have great impact on company balance sheet how this may effect final GC approval of those still continue? Most of us will have to wait 3-4 years before we get GC approved. Can it cause any problem or RFE? Or I-140 approval must be enough to show that employer is able to support the employee after GC approval. Just a thought.

My I-140 was approved on 10/08/2008. But I am not sure if it is EB2 or EB3.
My labor was filed with MS + 2years but My I-140 Notice Type says:
Skilled Worker or Professinal, Sec 203(b) (3) (A) (i) or (ii).
I will appreciate any feedback.

I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

I held an H1 B Visa from 2005 to 2008. I worked in the US from for 1 year from 2006 to 2007. I had to return to my home country and my visa expired in 2008. I have been out of US for more than a year and now I am on H4 status (not employed currently) and I would like to know the below:
1. Am I eligible to renew my previous H1 visa. Will my visa petition be considered as an extension of my previous H1 B?
2. Will my application fall under the cap exempt or will I be subject to cap limit
3. If the above fail, what other options do I have?
Pls guide.
