Thank you everybody that has contributed. We need to raise $50,000 in the next 15 days. That is $3334 raised every day. Now even though this looks like a big amount to raise, with a collective effort we can do this.
Goal by end of today: $23,338
Amount Reached: $6,300

Too late in the game. Lets just finish up what we've started. I believe in go green (I pledged not to buy another box of ziplocs) , but if 25000 sheets of paper will bring me my fixes, I don't mind planting 20 trees to make up for it.
Hi Needhelp,
Why don't we do signature collection instead of collecting same letter templates from all people? Do we need to waste this much of paper?
Go Green !
Sorry if i hurt IV member feelings.

Just contributed $ 200. Receipt ID: 00M756271K0810455
Frankly, with a priority date of May 2003, India, EB 3, I've given up on my own green card. I've contributed over $ 1000 so far to IV, excluding the $ 200 contribution I just made. (Making my cont. over $ 1200 so far)
At this point, if Anyone at all, ROW or whatever, gets Any benefit, its money well spent. I don't care anymore whether I get the GC or not... I'm getting older by the day, and the whole thing is looking more and more stupid... even surreal to me. The whole thing is piece of crock now, a Kafkaesque joke.

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didnt look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE. enough. I am not going back to US even for a visit in next 5 yrs..
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, youll succeed anywhere in this world, be it in US, Canada or Australia. Dont blame it on a country, but look at yourself.
Just my 2 cents.
Great. I agree one hundred percent. Once you have lived in Canada for a year, you will never want to look elsewhere. People and govt are no comparison. Both are very very helpful. You really feel at home in Canada.

I doubt if the house is going to toe the senate line on the CIR. The new bill that has been introduced in the House is seen as a rebuke to Bush, directly contradicting the Senate version. I think this CIR will be killed in the house if it somehow passes the Senate.

Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
Unless there is a real need, moving from EB3 to EB2 dont make much sense.

All of the senators just keep talking about the "illegal". When I do search for the word "legal" and get excited on finding it, it is preceded by the word "not" (again, not referring to any of us). Even IF CIR does happen what gives us the guarantee that our interests will not be put aside to make way for the illegal population ?!?!

First of all, it is not "my" case. I have been waiting in line for my green card for the past 5 years with my labor stuck in BEC. So, under the current CIR draft, I will be one of the biggest losers as I have not filed for my I-140 and so, my whole application will go down the drain after 5 years of time, money, energy and emotional stress.
How do you come with a math where I will be able to get a GC immediately after 5 years if I apply under the points system? Did you even read the draft bill? How will I or anybody else for that matter, manage for next 5 years without a GC when they are squeezing out the H1B (fee increase, removal of dual intent etc)?? Next would be the per country hard quota that will put us in an eternally long line.
I would definitely compare the current mess of a EB based system with the untested point system and take the current system any time as it is a known devil. The merit system is no angel either. Atleast in the current system, if I wait long enough, I know that my turn will come.
How do you know that process delay would be minimal? USCIS's current delay is not because of process, it is because of the sheer volume of applications and lack of man power. The PERM system takes one month. If you pay premium processing, it takes them 15 days to clear your I-140. So, where is the delay in process? All the delay is from the past backlogs which this bill fails to address and at the I-485 stage where they have to do background checks. That will exist in the points system as well. After you discover the problems in the point system, what will you do then? Ask for another CIR bill??
You don't have to tell what "my" case is. I live my case...
Well said buddy , some people have condescending attitude towards rest of the people. The applications which are pending for past 5 or 6 years will be just thrown in the trash and asked to goto a new point system which will not be available until 2 more years and how the heck one is supposed to get h1 extension.
Hope your labor gets cleared soon and will be able to file 140 and 485 before this mess gets anywhere ...

Dear Folks, I have a question:
For example, if someone's Advance Parole document validity is terminating on (say for ex), July 16, 2009, then, should the person apply for renewing his/her application prior to July 16, 2009? In other words, should a person's application to renew his/her AP document be made prior to the termination of the current one, OR, could this application for renewal be made after the current AP document's validity expires (in this case after July 16, 2009)? Thanks a lot, friends.
USCIS accepts AP renewal applications 120 days in advance of expiring AP. The normal processing time for AP is approx 1-2 months (usually it is about a month). Keep in mind that the new AP which is issued will have an immediate effective date from the date of issue and the start date will not be from the expiry date of old AP. So in most cases you will end up losing some days or even months. If you do not forsee any immediate need to travel you should wait till 30-40 days prior to old AP expiry and then apply. If your travel plans are unknown and you may have to travel if an urgent situation arises, then you should apply 120-90 days in advance to make sure you have AP validity at all times. You will obviously lose some days or months... but then who says everything that USCIS does is fair :)

refering to raju123's post of the aila document text: aila says that the amendemnt S.AMDT1249 could come to the floor or could be negogiated into the final version of the bill - so there is quite a chance that this amendment could be passed - hopfully w/o any changes.
Also on another note Senator Lieberman wrote a piece in investors.com which is pro-skilled worker and pro-H1B.
http://www.investors.com/editorial/editorialcontent.asp?secid=1502&status=article&id=264986175666607
In it he says "When the Senate resumes debating comprehensive immigration reform this week, I will fight to exempt from the cap foreign nationals holding a U.S. graduate degree in any field; a non-U.S. graduate degree in science, technology, engineering or math; or medical-specialty certification based on U.S. training. Taken together, these reforms would deliver much-needed relief — and vital human capital — to our innovative industries." .
Is the senator trying to come up with another amendment ? any which way lte us hope either 1249 or a possible Lieberman amendment passes.

Isn't that good news? Atleast we wont have to redo the medical exams if that were true.. Or do you think this is a strategic move by USCIS to be immune from any lawsuits?
I have always been of the opinioin, that the most correct thing for the USCIS to do at this point is to not return the applications, but hold them until Oct. When the window technically re-opens, just swallow everything that is on hold - the window technically only needs to open for a few seconds for that to happen.
The other thing they should also do is accept all 485 applications till the end of July and process them likewise.
Giving everyone EAD/AP benefits does not hurt....they can then line up all the 500-700K people and issue the green cards as per visa number/PD/RD availability...

here is the thing folks, until now I found no place where it details what exactly has happened. some people say they were racially discriminated, some say they didnt have transit visa...no one exactly says what has happened...
that being said, I flew airfrance, as far as I remember, once and I swear i had no problems..attendants were every polite. Ofcourse on the ground in Paris, when I walked in to a store or whatever , the girl in the store just didnt ack' me when I was asking in English, who cares, I left the store. Other than that, no problems folks... but i do understand everyone would have a different experience...
ps: I just cant believe that AF still replied to the comment/feedback to the OP's "stop racism you.....", wow! that was something..you gotta give credit atleast for that folks..

Folks, don't make travel plans based on the approval e-mail that will be sent of automatically from USCIS. Mine & my wife's application's were approved and mailed nine days ago (6/18) and we made travel plans for yesterday (6/26) . Guess what. I got my approval notice in mail only yesterday and my wife's approval doc never came. We have to cancel the whole trip now.
Also, USCIS updated the status on our AP's four days later after the approval e-mail was sent saying the documents were mailed only on 6/22. Called the USCIS customer service three times and I got three different answers.
1. We sent approval notice on 6/18 and will be sending the AP document soon (In fact there is no such thing called approval notice and AP separately. This guy has no idea what he is talking about at the USCIS)
2. We sent the approval notice on 6/18 and confirmed that the document is out in the mail where in fact the document I received yesterday had a USPS stamping day of 6/22.
3. We sent the document on 6/22 and you should be gettting them in less than 30 days. If not please give us a call back.
Lesson learned. Don't trust USCIS and USPS delivery system and don't make travel plans unless you have all the doc's in hand.

Dear Members,
We are working hard to assist our members coming to DC for the advocacy days. Many members have been helped by local DC members by providing accommodation in their homes.
We are trying very hard to manage the high expense of this event ranging from booking a conference room in a hotel near Capitol hill, printing and buying bulk media drives for each meeting, organizing a press event to Congressional reception expenses. Our budget is $50 thousand dollars for the entire event and we are struggling to meet this goal. Our minimum budget for these events is 50K budget. At this time we have received around $7,500 dollars as contribution from IV members, and we wholeheartedly Thank every who has contributed. But we need everyone to step up to the plate and do their fare share. We have a tough road ahead and we need every one to help for their ow cause. In the past IV Team had spent their personal resources to get the effort going and have our voices heard. We are all working hard to organize these events despite some of the core members already getting their Green card holders. It is now up to each member how valuable they view this effort and can stand up for themselves. Each one of us is participating this effort for own self rather than doing any favor to others or to IV. Please donate generously for this event so that we can make it a success..
http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1534974-funding-drive-iv-needs-your-support-for-advocacy-events-in-dc.html
Travel:
Some members have approached us seeking help in their tickets. We are not in a position to pay for travel or arrange buses for anyone. We would like to help them by starting this thread and urging other members to donate their skymiles to others that are coming.
Please post on this thread if you are willing to donate your skymiles. An IV representative will keep a tab on all skymiles and connect both the donor and recipient after verifying that the recipient will be coming to Dc and using these skymiles only for the advocacy days for himself.
We have a member from a state where we do not have many members and needs American Airlines miles. He would need more than 1 lakh miles. There are a few more in our list.
Carpool:
If you are driving to DC, please post so that others can carpool with you.
Accommodation in DC
IV urges local DC members to volunteer and provide accommodation to guest members from other states in their homes. Please post on this thread if you would like to open your homes for other IV friends.

Hi guys,
This is what my lawyer said.
If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.
If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).
You do **NOT** need the $80 Biometric fee for the Advanced Parole.
Guys,
do any body know what documents a minor need for reentry using AP?
Do they need EAD or just I-485 receipt is enough. please reply ASAP.
thanks

I got a RFE on my 485 on 11th April and I have responded to it. By next week it would be 60 days by which USCIS has to take some decision. What would be the status update as my PD is Aug 2006.
Is it normal to get RFE while PD is not current?
