Pardon my intrusion here! I searched various forums but I couldn't get any solid threads on visa number because it is so common term the search always yields wrong threads! so can some one tell me..what is a visa number after filing 485? is it same a A # ? or is there another number besides A#? Do we see it on 485 reciept? if not how do I find out? I
They have preassigned Visa numbers to cases that were pending in USCIS(NOT the ones filed in JUNE)...even though the PD was not current according to June Visa Bulletein... Eg: COnsider your approval and mine..We filed for 485 in 2004.. These cases are preadjudicated and just waiting for Visa number to become avilable..Once the july bulletein came into effect(or according to rumor even before) they assigned visa numbers to all pre approved cases that were pending...AGAIN USCIS DID NOT ASSIGN VISA NUMBERS TO CASES FILED IN JUNE

Listened to the recording. I simply cannot believe what the host was babbling again and again about. He was repeatedly asking Jay “Why should the laws be changes which were set 50 years ago?” I will tell him why the laws are normally changed in general (not related to our case at all). They are changed because by definition law is supposed to be just; it is supposed to be equal. It is required to be non-discriminating. It is changed because people’s life is affected adversely if it remains constant. Laws of nature are the only set on laws that cannot change and that is true because they took billions and billions of years to perfect themselves. Laws of any country on this earth are not perfect. They are made by human beings, who tend to make lot of mistakes. Now, what is amendment? It is a set of new rules that are written to rectify any mistakes made in the existing laws. That itself is changing the law, my friend Raj. There is no county on this earth whose laws have remained the same for a very long period of time, and yet keeping all the people in that country happy. Laws get changed because of the new values added to the system. That is why, my friend Raj, slavery was abolished in 1863 by President Lincoln (BTW my most favorite President). This did not happen by magic. It happened only when the president issued an Emancipation Proclamation, which basically is a law and the jist of that is , "all persons held as slaves henceforward shall be free”. Now how did this happen? Because of the civil war and why did the civil war took place? Simply because people cannot take it anymore. You are correct Chandu. I confirmed with attorney based on some discussion going on in other thread that made me concerned. H1B and GC are complete independent for status.

H1b and AOS are two differnt things and are not coupled. A yearly h1b extension beyond 6 years is given if you have a Labor pending for more than an year or pending 140 more than one year and a 3 year h1b extension is granted if you have an approved 140.
So the basis of getting a h1b extension or transfer is 140 and not AOS. One may not have even applied for AOS but can get h1 extensions as long as the above conditions are satisfied.
This is based on what I know. Thats why Attorneys prefer h1b compared to EAd because h1b essentially gives time for you to change jobs/apply for new GC petition in case existing petition has tons of issues etc...

Please understand few basic facts.
Much of the work that we do is not on the website but behind the scene.
We need resources to carry the message to the lawmakers.
Resources are contributed by the members.
All members do not contribute, and then there are those who contribute.
We have created a specific area on the website where more serious members who are willing to open their wallets, could actively participate, and that will enable us to enlist more active members for the work that we do behind the scene.
Its just one way for us to recruit serious members to help us with more active work and at the same time help to continue with the organizational goals.
From time to time, we will also seek advice from the contributing members. And when we need more help, we will reach out to everybody on the website.
Rest of the area on the forum will continue to be the way that it is right now and every member will continue to access it the way you access it right now.
We are soon going to introduce new and more helpful features for everyone.

Guys/Gals - Those of you who are planning to file your 140 and/or 485 and are worried about the future consequences, please stop worrying about the bill and first of all get your 140 and/or 485 filed.
Now, when you are done with it , please help IV to ensure that the current bill has enough amendments to make our future secure.
If you are one of those who can keep working on your 140/485 , worry about the bill and help IV all together in a balanced way, no need to follow the step by step process :-)
Things happen - they can always happen - they can be good - they can be bad - but Life Goes On.... so you do what you need to do for your current processing and whatever plans you have for future but just be aware that things can always change. Say you dont file your 140 assuming the world's gonna end and then before the world ends, 140 premium processing is stopped - ( not that there are any rumours regarding this ).... so get the point - carry on with your processes assuming the best out of this bill and help IV as much as you can.

My husbands DL expires on Oct 1st, 2007. The North Carolina DMV insists that he should have a valid H1B visa stamp in his PP in order to renew the license. He does have a valid H1B extension with I-94 at the bottom till Oct.2009. We dont want to leave the country as we are filing for our I-485's.
Any one in NC have any suggestions?

1 point we should make to the lawmakers is to make an administraive change to give 3 years extensions and abolish 1 year extensions. As 1 year extensions are not suffecient a very solid case can be presented for that case.
1) Driver license, lit of state doesn't give DLs if you have less than 1 year left on Visa
2) H1B Extension is taking 4-6 months
3) No Visa stamping in U.S.
The problem are just too many we need a proper channel to raise our voice to them
Also we need to ask for some accountability and transparency in the Backlog processing. All of us (victims) with LCs in the backlog centers have been reduced to foolish gamblers trying to figure out what is happening with our applications.

It really depends on who you ask. But my point is if you decide to stay in US in the long run, aren't immigrant divided between their kids and their parents?
I dont think one is necessarily doing kids a dis-service by electing to go back. On the contrary, kids experience tremendous personal growth through interaction with extended family which is not possible in a foreign land.

yes they are indeed. I took care of this as my sisters and parents have immigrated to New Zealand, work and live happily there and will be covered by a great social security system.
also, they do not need a visa to visit me after they get their citizenship (in the next year or so) and I will not need one to visit them after I get mine in the next decade or so.......... :-))

There was a campaign on wrongful denial in AC21 , there was also letter campaign not sure what happened after that ? It was IV action item too... What was the conclusion ? should we all suffer even if it is a training issue, if they act such nice on letters , then why they act as if there is no form and if AC21 is for real aliens from a real alien world.
Bigboy - those were good enough to help us reach Ombudsman's office and the result of those campaigns was that the Ombudsman's office now have a page on their website addressing this issue. Not sure how much it is helping though but as such, if anyone is having case problems, they have to contact the Ombudsman because their office is officially supposed into case problems and am sure - they have their liason at the service centers who may monitor such decisions at an individual case level.
Not quite sure why these things are continuing to happen.
