To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

Now it's clear. You don't want people to drag you down, even when they have had gone through everything, Labor, I-140, been in the country for 10 years, etc. -- I thought you had a noble cause from the older posts, but apparently I was wrong.
This also started getting ridiculous. In my own post, and agreed by almost everyone else, I specially said to put on restrictions to those who can file AOS, e.g. with I-1140 approved, or with a PD older than a certain number of years. Where did you get the impression that every H1 can arrive this country and be on EAD in six months? Why did I found that the extreme generalization and scare tactic employed by you has an alarming resemblance to those from Lou Dobbs and Grassley?
And to answer your last question, even with a PD of 2007, I've been in the US for ten years, but could not file green card due to company bankruptcy, layoff, etc. and I am 90% certain you've been here shorter than I am. Then should give up your EAD till everyone who stays here longer than you does?

I am with you on the ludacris comparison brought by hydboy77. He keeps calling the EB3-EB2 porting line cutters as if these guys were paying 10,000 USD to buy substitute labors. Those Eb-3 folks have stood in line just like him, you and me and have an employer who values their contributions and has a position that has EB-2 requirements he can hire this EB-3 guy. Rather than thinking about the problem at its root, he keeps attacking people who port their PD and calls them line cutters. Bottome line: He has EB2 PD and worries that he will be screwed worse. While it is good to worry about the problem, it worries me when that worry comes at the expens of other's good. Jeez! we dont need anti's. We get dragged down by your own. Probably he does not know what USC code 1571 section 8 says even before AC21 came into picture. Congressional intent was to get a GC for every one with in 6 months. Infact he does not want every one to get EAD because he is scared. Doesn't a legislation that takes out the similar/same after 6 months and gets every one on to EAD is the best one as people will be able to demand what ever they want and put the kabosh on Grassley who keeps bitching that H1B's are paid peanuts?

Obama is no panacea either. Why do you think someone with little experience is a liability to be second in command, but the same lack of experience is admirable quality for the first in command.
Also, Obama has been changing his positions on issues to pander to the voters, I doubt he will be any different from Bush either. The only change you are going to see is in himself -- not the way things are done. He will probably pay more of the tax monies to people who gambled with their houses (and are still not being punished for it).

In future if someone wants to reach us if you have any question, it is better to directly contact us rather than posting on the forum as we do not read every post.
A couple of people who got the letters have already emailed us and let us all review the letter to see if we are getting what we need from this request. Let us all agree if we want to pursue this and contribute towards this. Once we have enough people, we can go forward.

The messages you are getting from your House reps and Senators are standard messages that they have on this issue.
Please do not be discouraged by the email back messages from them, because frankly it is just an automated standard reply.
The idea really is to make them take notice and hopefully have some body (staffer) read atleast one of our email messages entirely and realise what our issue/s are. We need to make them aware of us- "Immigration voice" as an organisation and educate them on the issues we face. So if we continue to send them messages, that will be a big help and it builds momentum towards the advocacy event.

I guess I am little late on this post but I thought I would share what I got from the USCIS Call Center.
My application reached on July 2nd. When I asked the representative about the fate of my application, first she said I should be fine. Then, I asked about the updated July VB and she put me on hold for 2-3 mins. She came back and told me that my application would be rejected and sent back in 15 days. When I told her that my application was received before DOS released the update and technically my application was received by USCIS when the bulletin was still current, she said that would depend on the descretion of that USCIS office.....funny but that's what she said. Again, she said that I could reapply in Oct and they will process the application then. But when I asked whether she was sure that VB will be current in Oct, she said USCIS doesn't know that.
So, the bottom line is.....there is no point in calling USCIS and asking them about the current fiasco as they themselves are unsure. You can still call them and you might hear something different but equally confusing.

Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

It would soon be 9 years for me to be here in US, my 2001 app is in DBEC. I have been with the same company for almost 7 years, have survived through rounds of layoffs, and so many other personal issues, I can not even count.
Despite this I am willing to stay here and give it some more time.
For the first time in last many years, while my app was rotting at SWA, I have seen an concentrated effort by an organization to raise immigration issues.
I am willing to see what IV does and how far reaches in it's goals, at least various lawmakers are aware of our problems now.
Keep the faith, hang in there, this is a really long tunnel but after so many reversals, it about time we see something positive done for us.
As for the those who say, "US doesn't care, i will go back, US will get hurt", I don't buy that argument, US will not get hurt, despite so many problems US still remains a magnet that attracts talent from all over the world.
If you leave, or if I leave will have very little impact. And even if u go back and start working for TCS or Wipro, they will send you back to US on a project.
Unless you want to start your own business, I don't see much benefit in going back and working for the big consulting companies. And if you want to start business, why not start here, who is stopping you? ok, i know there are limitations on H1 etc, but there are many loophopes work around those.
And what if things change in India? if things are not in your favor there, where will run from there? where will you go?
My point being that we have a pretty decent chance to getting some immigration relief here, IV is working towards it, instead of saying "forget it" I am leaving, let's all learn to fight.
Let's all learn to work to solve this problem. Work with IV, work yourself to get one of these bills passed.
If nothing else, lets's all make it a point that every 2 weeks, we will write a letter to our lawmakers explaining the problem and asking for relif. every other week write to a media channel.
Even if you are not great at writing letters, just write what you can and send, it doesn't need to be perfect.
Eventually, someone will notice, eventually someone will do something about it.
So, for all those who are thinking of running away, I am saying, how about stay here and fight here. Let's stop taking the easy path out everytime, if you want your benfit, stay and do something positive.

I sent my EAD paper file on 29th May to TSC. I received my EAD's today for 1 year. Cutoff date for 2 year is 30th june.
