The Key Point: Equal opportunity employment advancement is protected by Constitution ("Title VII of the Civil Rights Act of 1964 (Title VII)")and hence the Supreme Court can overturn the per country quota limitation if the Supreme Court finds that the per country quota leads to discrimination at employment, which is unconstitutional.
You are missing the key point here.
Equal Employment Opportunity applies only to applicants who are eligible to apply for that job. It does NOT apply to immigrant visa allocation and any other visa benefit such as H-1B approval.
In other words, Equal Employment Opportunity is applicable to US Citizens and residents with work authorization (Green Card holders, EAD holders, person with H-1B approved) and this is limited to job hiring, job promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. This does not extend to immigration benefit or opportunity lost due to lack of immigration benefit (such as I-485 approval).

If you have read this post you have also read that IV won't inform which firms that they are going with, and the change is because of contract expiring. Please stop letting your disillusionment affect ur judgment. All people can do is join state chapters and contribute more. If you feel this leadership is going nowhere why don't you give up some of your free time and do some active work and contribute more.
ok, i am beginning to lose confidence now... first no i-485 relief and now wait till CIR>.....last year, CIR turned out to be a big circus....i hope this time something productive happens....
why are we changing lobbying firm? what do you mean it is a strategic decision?
are we dissatisfied with our lobbying firm? pm me if you can post on public forum..
but we need answers....this leadership is going nowhere now......

If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.
H1bslave, in your case your PD is Sep 5 EB2. I see something in the distant horizon. PD of 2007 and beyond or EB3-India I see no hope.
Atleast you can survive on a lifeboat called EAD and AC21.
Note that list of occupations changes constantly. I lived in Canada for 20 years after coming as PR on point system. It works well there, if you think money is not everything. Education is equally good. People, of course are far nicer and friendlier. Even border immigration and custom staff show a friendly face and attitude..

Does an MBA from a foriegn University Qualify for an exemption of CAP of EB2 Visas?
I was thinking one has to MS in a US university to qualify.
Thanks for further clarifying.
There are two categories of people who will qualify for the exemption
1) Any person with any advanced degree from a US university. There fore the following would qualify as examples:
a) MS in Computer Science
b) PhD in Mechanical Engineering
c) MBA
d) MS in Physics
e) MS in English
2) Any person with an advanced degree in STEM (science, technology, engineering and mathematics) from a non-US university (i.e. minimum of 18 years of education: 12 years of school + 4 years of bachelors + 2 years of masters) + minimum 3 years of work experience in US in a "related" field. There fore the following would qualify as examples:
a) 4 year bachelors + 2 years of M. Tech in Chemical Engineering from China + 3 years as a chemical engineer in a company in US.
b) 3 year bachelors + 2 yeas of masters + PhD in mathematics from India + 3 years in mathematics related field in a company in US.
3) The following as examples would not qualify:
a) MBA from a non-US univ.
b) 3 years bachelors + 2 years masters from a non-US univ.
c) Masters in English from a non-US univ.

Risker,
I agree with you 100%
If we have filed our cases earlier - We have every right according to me to get our cases approved before others.. If they leave status current till everyone labors are approved (According to backlog center Sep 30 07) - That would resolve the issue/confusion.
If a clause exisits for us mentioning our 140/485 would be accepted next month would resolve the issue - any thoughts!!!
Regards
Baboo..
P.S: Others whose cases are current - I ' am happy for you too..

Mandal ka Kamanadal will do. What this means is that we are back to square one. All the effort, money and energy was spent on making sure that we didnt get screwed any further. Meaning, it hasnt moved us a step ahead but just helped us to retain our positions without going back.
END RESULT - NULL....hhhmmm would I be stereotyping if thought too much into it???
Would appreciate the input of all..just my two cents

..this probably is a dumb Q, but will a US STEM PhD, for e.g., require employer sponsorship to file under EB under these Frist/ Specter bills, or can it be done employer independently, as I believe, PACE allows for a select few?
Thanks guys for your time.

That right doesn't come without a responsbility - put your wallet where your mouth is. We have seen enough of these 3-4 post members suggesting "change" in leadership sitting in their cozy armchairs.
I know understand why lawmakers want to club us with illegal aliens - because many of us, inspite of our so-called superior education, are in fact worse off than the illegals when it comes to putting up a united front against numbersUSA. So maybe we need the "cover" and "protection" of the illegals to get our provisions passed. Shame on us !!
As a member, I have full right to suggest a change of leadership when I think it can help.

My opinion even if CIR is dead this year, as long as Kennedy is alive they will come back in 2009 with similar immigration bill with no benefits for eb visas and the whole story will repeat we will have ours fingers crossed and IV will try their best to tweak in some amendments and again it will die for the same reasons, as they are not going accept any amendments until grand immigration bill we will wait for next CIR and we go into infinite loop.
may time will pass and 10-15 years like this and we all will get current some time and eventually get visas.
I think it is better if we get over with it either good or bad at least we can come out of limbo.
and then try for new amendments.

Lets do the best we can. If it does not work, we are no worse than where we already are.
A group of us just went to Lamar Smith's Austin District Office and detailed his liason about the bills, benefits and information about IV. She said she will have them Fedex'd today to their Washington office and keep us informed about congressman's stand.
Thanks for doing that for us, Iskreddy! A visit to his office will definitely help.

To pbojja, your post shows how you may have completely misconstrued my post. I haven't written the post out of frustration of not being EB-1/2 at all. And am I dreaming when I hear you say that good English speaking skills aren't important in the U.S? Maybe I am in another world. I said clearly that the 'fraud' desi firms and their employees have tarnished India's image. They should be removed from the system and we should be in line with 'genuine' cases. What's wrong with that? Where's the unfairness here?
To snathan, I understand your post but I believe the tone should be more friendly and amiable. And I certainly didn't give you any red dots so peace on that front. I don't believe in petty playground politics. Actually I appreciate you reminding people about contributions since they are needed a lot for our efforts.
Also, I can see my profile turned red since people haven't understood the essence of my posts. Very sad situation indeed.
StuckinMuck,
Dont get into other things when high priority issues are to be focussed. Focus on removing country quotas, release the numbers lost, get GCs for 5-10 year waiting folks, get citizenships for anyonne more than 10 years legally in US, project yourself with good things. There can be 100s of bugs in the system, but this is not the time to cleanup.
Focus of projecting good things about us, which are PLENTY.

I think there is a bipartisan support for the schedule A visa recapture and moreover its a nations documented shortage professions. I think this recapture of nurse visas is imminent no matter what we do.I think our focus should be undiluted towards the CIR, and it should not divert our focus from that. Opposing the nurse shortage would in fact show is in a poor light and we should make an reasonable yet a firm approach towards a long term approach to the issue. There is allready a talk to completely exempt nurses from the visa cap, and i hence feel our opposition would appear irrational. Really appreciate what IV been doing, there is no quick fix to the problem, the goal should be approached systematically and persistently.

How long does it take to get the "prevailing wage info"? Does it come from State DOL or the Federal DOL?? I'm from Ohio
Thanks
Nat
Hi Nat,
Fragomen took about 6 months in getting "prevailing wage info" for my case in 2001. My manager ( Canadian who had gone through US GC process himself) finally talked to them and asked them to file without waiting for DOL's reply on prevailing wage. (That was a risk but we agreed to take it at that point)
That six months delay costed me 6 years in GC processing ! But thanks to my manager , otherwise I dont know how many more years I would have waited.(One of my co-worker still awaits his labor cert !)
The big law firm goes by predefined steps , which are probably the safest way for most cases but may not be the fastest way. You need somebody who has been through this process and can understand and asks good questions to lawyers and can help lawyers to think for your perticular case. Check if you have somebody in your org to do that.
All the best.

May be we should try to lobby for a bill with one time relief of Backlog of EB retrogressed.
I feel that once this backlog is reduced, it will be easier for future applicants anyway as H1Bs are reduced to 65000 from last few years.
I request IV core to look into this option as the opposition from anti immigrants would be less for something like this. This has happened once before in yr 2000.
