Hi,
My employer has filed second extension and due to the fees was not sent with the proper amount they sent back the application saying it has denied and sent an I-290B with it to apply for appeal, i just got a letter and my H1 was exp in Dec 07 please help what shall i do, i am in helpless state my employer is working but any help or info is much appreciated.

Quick question on behalf of my friend. His H1B is being revoked by the present company. His previous employer did not revoke his H1B, can he go back to the previous employer without filing for transfer or should he file for the transfer again?

They will definitely accept the copies of the check. The reason I applied my I-140 in May 07 and didn't got any receipt and I intend to file PPS for which I require copy of I-140 but when I talked to the customer service they suggested me this solution and after that I got my check photocopies from my employer

Well-said POSMd. It must have been very difficult to spend time (even it is 1 Hour a day) after your job towards a common cause. Voluntarily.
Hopefully those who are in frustration, though understandable, can come up with other better ideas to help resolve the problem. I suggest ,contact core Team and let them know how can you help with your time.
My understanding, progress on problems like this can be expected in Months not days.

I filed I-140 on July 5, and was hoping to get the receipt by this week because as per the press release ( dated 7/13), NSC was supposed to be time complaint with regards to I-140 receipt date by 7/18/2007. But they again changed to 8/1/2007. You never know they will NOT change it again!

This country seems to be discriminatory against everybody except for people from Mexico and Latin America. The per-country quota's make sense since one wouldn't want immigrants from a particular country or set of countries (India and China) to disrupt the racial mixture of this country. But then why don't they apply the same logic to illegal immigrants from Mexico? They are predominantly of the same race and if they are allowed to stay here and bring their families, it won't be too long until they are the majority ethnic group in this country. Even if one assumes that there are a million plus applications from Indians and Chinese stuck in the green card line, we are only a small fraction of the total number of illegal immigrants! If you are going to have per-country quotas, apply them uniformly across the board- don't give amnesty to millions of people of mexico who are also brown skinned, while making legal, law abiding people from other countries wait for decades! Imagine how long it'll take for illegals to get a Greencard if they applied in EB3 and waited in line for their visa number to be current like the rest of us. Most of them would probably go back to where they came from once faced with that prospect.
I find it highly Ironic that EB2 is current for Mexico and not for India, even though Mexico sends tonnes more people here than India.

My numbers are not 100% accurate , but it gives fair sense of the current situation.
Here are all the LC approvals for India in the last seven years.

Lets assume about 25% of pre-PERM LCs are India based on post-PERM data. Thus for fiscal 2004 (Oct 2003 thru Sep 2004) the total LC number is 43,852. Assume 25% of that to be India based on PERM data. That gives about 11,000 India LCs in 2004 alone (All EB categories combined). If you assume an average of 2.5 dependents then the number of visas required for all India EB categories for 2004 is 27,500 (11,000*2.5). The regular quota for EB2 and EB3 combined is only about 9,800. That means 17,700 visas have to come from somewhere. I dont think those many visas are remaining for this year. Be prepared to see FIFO thrown under the bus and approvals with PDs that are all over the place. Please critique this analysis without piling on. Thoughts?

The only positive I can take from this is that it will remove most if not all the US masters degree holders from the general queue.
It may take time but atleast for people such as myself (direct H1B in 1999), we can move up in the queue.

On a serious note though, You provided so many ways that money is being raised by running marathons, funding drives etc etc...but come on, where on this website or anywhere else is it mentioned how this money is being spent??

dont be confused with "legal immigration", legal immigration in obama's world means family based immigration (vote bank politics) not EB immigration.
This is becuse about totally about 1 million people immigrate into US, out of which EB immigration is just 140K. Remaining are FB based. So, always EB is a piggy bag rider. In US, genereally immigration means family based immigration.

Don't waste time by calling National Call service center. They all are dumb !! They don't know anything. They just read the on line status of our case, which 8 year kid can do.
According to the first guy I talked to, one has already been assigned upon the start of processing of the case.
I just called again and the lady was completely clueless about the whole July 2 fiasco. I will try again in another hour and hopefully I won't get the village idiot again.
For anyone interested in calling themselves here is the info: 1-800-375-5283 options 1, 2, 3 (and possibly 6 after that-I can't remember).

Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.
