    Its a known fact that the pay structure in Gulf countries are different based on the citizenship.


    I don't know about the gulf. But Singapore and other Asian countries, pay structure is different for different race and skin color. This happens even if you have GC or citizenship from US.

    You are certainly entitled to your interpretation and Mr. Gotcher is entitled to his but I wouldn't go as far as calling it a ploy to increase more traffic. I am not sure if you are an attorney but he is and he certainly has more understanding of immigration law than most of us here. As with any law and immigration in particular, there is room left for interpretation and Mr. Gotcher is simply stating his point of view. You are more than welcome to disagree with him but I wouldn't call him greedy.

    i dont think its a controversy. mr. Gotcher does not agree with the interpretation. Maybe its a way to generate some additional revenues for his firm by increased traffic to the blog and potentially a class action lawsuit on behalf of the ROW people.

    I understand that it might be late and filing a case might be expensive etc. But how come people like murthy.com etc. were willing to fight the sudden revoking of I-485 by UCIS along with AILF? It will only be hypocritical to consider that as injustice and this as not. I don't think filing a case is going to bring the whole process to a halt. The BEC will still continue to process the cases while this case goes on.

    We have to do away with all those naysayers and all those IFs and BUTs. I don't belive in it.

    We know we have a justified case here and it is a simple matter of whether we are willing to fight.

    Why can't we get the support of AILF for this or other law firms? I know there are enough people who have been affected to justify that.

    No need to jump the gun. I didn't ask it at a personal level, in case you didn't understand it! Instead of nitpicking on a single statement, read the whole paragraph! I am a member of a state chapter and keep posting on the Yahoogroups, though it's been a month since anyone else posted there ( and I don't get any replies).

    I'm not getting into personal level/ad hominem discussion as it's pointless. I don't need to prove anything to anybody.

    I read and understood the whole paragraph with both "published" and "Hidden" messages what you wanted to convey. If you do not see much activity on your state forums, why do not you take the lead to reverse the course? That would be the right direction rather than suggesting to change the skeleton. Do you blame yourself (Since you are claiming yourself a member)for not having much activity in your state level? If not then problem lies there and that is my hint to you.

    Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.

    I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems.

    I am definitely in for such a initiative.

    Explanation - At the time when the application (i.e. I-485) is filed by applicant, an immigrant visa is immediately available (i.e. PD is current).

    I have been a passive follower on IV for few weeks now. I read the news clippings that people had posted where there was some Gautam Aggarwal who felt the point system was good. I see a press release from him that I saw floating around some mailing list.

    Quite honestly even though lots of us disagree with him, he does make a very valid point. IV should consider clubbing US educated people such that 2 separate quotas can be created. Instead of banishing him as an elitist look at his point he is making by just marketing how the country is using the educated. Using a well respected university name is no different than talking about how we legals pay taxes etc. Just because we are educated and better of that the illegals as an argument is no less than elitism in that sense. I happened to go through gautamagg's post after the Guitrezz rally - read his message again sans tone. He makes a point. This CIR bill could have been good for us if we approached it positively looking at US educated people as a group too. Also his statement on the AP report about MPS being good is not totally incorrect in an environment where both EB and MPS may exist - if we can get that i.e. EB and MPS keeps both sides happy and we should fight for that. I emailed gautamagg and he did mention that the AP report cut out that part of his statement and told me to verify that with the reporter if I wished to. I think we guys need to be less passionate before we throw stones at others. IV is definitely doing a great job but people should share opinions openly on strategy - we are all humans and we may have missed an important aspect at IV - most IV folks seem to be non-US educated consultants and therefore disagree with Gautam. We really are 2 diff groups who want the same result with better partnership. My 2 cents. His press release:

    “Grand Bargain” Immigration Bill creates issues for International Students in Economics, Finance and Business

    Mountain View, CA – May 28, 2007 – The US Senate is actively debating the proposed “Bi-partisan Grand Bargain” Immigration Reform bill. While the bill does have many provisions to attract educated people from outside the US, it also creates restrictions for people with an economics/ finance background.

    One of the proposals is to introduce an additional visa category for people coming to the US for graduate study. Though the proposed F-4 visa category is welcome by the international students’ community, it is unfavorable for people with a non-technical background or for people with a technical background who would like to gain additional skills outside of technology to be successful entrepreneurs. The proposed category, called the F-4 students visa, allows international students two major provisions that the existing student visa, the F-1, is restrictive in:

    1. F-4 students do not have to prove a non-immigration intent. Unlike F-1 visa applicants, students coming on an F-4 visa will have the ability to have a “dual intent” at the time of applying for their visa, while entering the Unites States, or while maintaining their F-4 status in the US. Such students can have a pending Green Card (GC) application or can apply for one while on F-4 status. This is in contrast to the existing F-1 category in which a previous or current intent to immigrate to the United States negatively impacts a persons ability to obtain an F-1 visa.

    2. Under the F-4 visa, instead of 12-months the students will have up to 24-months of Optional Practical Training (OPT) available after graduation. The larger time window will help students evaluate employment options while staying agnostic of visa issues.

    The bill restricts the F-4 visa to people who would attend advanced degrees in the fields of Science, Technology, Engineering, and Mathematics (STEM). Such limitation to STEM alone would negatively impact the inflow of international students to other graduate programs such as Finance, Economics, and Business. In today’s dynamic global economies, technology and business work together. Over a third of the MBA class in top US schools such as Wharton, Stanford, Harvard, and Cornell comes from a technology background. Restricting these provisions to STEM degrees alone will result in a severe shortage of highly skilled international students coming to the US for an MBA due to an advantage the STEM degree holders will have over them. This will impede the abilities of many “technologists” to obtain business and finance education and will reverse the positive trend in places such as the Silicon Valley where many engineers turn into successful entrepreneurs creating wealth and job opportunities for many Americans and add to America’s competitive edge.

    While the Senate has shown foresight by introducing the F-4 visa that helps in retaining people with advanced education from the US, it remains a very myopic solution to the problem it intends to address. Next week, the Senate comes back from recess to discuss amendments to this bill, this press release appeals to the Senate to consider enhancing the provisions of the F-4 as well.

    Note: Hundreds of people are affected by this already. With a Masters in Computer Science from Cornell University, 7-years of technology experience in the Silicon Valley, and after paying over $ 150,000 in taxes, Gautam, issuer of this Press release, may be unable to join his MBA class at The Wharton School this year. Because he had once started his Green Card process and established an “intent to immigrate”, it is difficult for him to reverse the process and obtain a students visa. Over 3-4 years of processing wait times has resulted in many people such as him to give-up their applications in lieu of additional education. But, their past intent looms over their very uncertain future: 22 of them have connected with each other and pray that their Indian Gods stay happy with them on the day of their student-visa interviews in India and that reason and common sense prevail.

    One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.

    True, But I guess everyone is trying to hold on to any or all of these fading rays of hope.
    On a lighter note, I did watch sausages being made, and I can't eat them anymore.

    There are uglier things than sausages being made. For example, when Bernie Sanders gave a 30 minute speech to increase H1B fees and make H1B program useless, he brought a big chart and the whole enchilada to try to prove that H1B depresses wages.

    However, in the starting part of his speech, he said he supports the bill.

    The bill brings in 200,000 guest-workers each year (it was 400,000 before Bingaman amendment). However, according to him, that is just fine. When guest-workers come to US in numbers like 200,000 then they dont depress wages of the lowest income group in America. However, when hi-tech workers come here they depress wages.

    This is the kind of logic from people like Bernie Sanders and Co. that is uglier than watching sausages being made. Watching sausages being made might hurt your eyes, but this kind of logic hurts your head and can damage your brain's neurons.

    what about countering efforts to corner EB3 unused visas.

    I appreciate the efforts of core IV and have held them in high esteem. As I said in my post, I read all the posts / replies that I am connected to with sincerity of purpose.

    Yet, I don't see a response to set up this web fax. We need to write and counter this grab of unused visas.

    This is a good first step in this direction after our campaign for FOIA last year. If we can get the data we need, prediction on date movement and getting the clear picture on pending applications should be easy.

    I personally feel 5K is too much to charge, but if this is what it takes I think we should pursue it. Lobbying for it may have cost more. We need to get more information about this and if everyone agrees we can raise funds and pay for one request to take it forward.

    Based on the wording of the visa distribution law, it does not look like the pattern change is a permanent one. The pattern might change again as per USCIS whims and fancy.

    Read the part "Nothing in this paragraph shall be construed to limit the authority of the Secretary of State to determine the procedures for the processing of immigrant visa applications or the locations where such applications will be processed."

    This whole discussion got so twisted ...so here is the gist to bring everyone back on track.
    USCIS's interpretation of law for the "redistribution" of unused visa numbers is as follows (FALL ACROSS) : arrows denote transfer of excess numbers from categories

    EB1 -> EB2 ROW/IN/CH
    EB2 ROW -> EB2 IN/CH (proportional)
    EB2 ROW/IN/CH -> EB3
    EB3 ROW -> EB2 IN/CH (proportional)

    Ron thinks that this is wrong and it should be as follows (FALL DOWN):

    EB1 ROW -> EB2 ROW -> EB3 ROW
    EB1 IN -> EB2 IN -> EB3 IN
    EB1 CH -> EB2 CH -> EB3 CH
    and at the end then cycle through unused visas to single state categories

    I believe that USCIS's interpretation preserves the intent of the law makers to create maximum benefit to the US employers.

    I am very glad to know that you are going to introduce a bill to help retain American Tecohnology Competitiveness termed as SKIL BILL. In regards to that I would request you to kindly consider adding to this bill a provision of awarding Green Card to skilled workers who have been in this country for six years legally and continuosly? There is something similar to this in UK immigration laws and this provision will automatically reduce the plight of the "silent minority" who have to wait for years for their Green Card approval and not able to change jobs etc. For senior professionals with many years of experience this is a very frustrating experience and since the whole process drags on for years many of them are forced to leave this country because they cannot take long term investment decisions when the future is always so uncertain.

    Having a provision of automatically awarding Green Cards to H1B visa holders who have been here for more than 6 years and have applied for a Green Card will have the following positive results: - Lower the workload for the Immigration Services and streamline the process. The fact that someone has been here for 6 years legally and paid their taxes should entitle them for a "express checkout".

    - Give a boost to economy (housing etc) as the professionals with Green Card can make investment decisions.

    - Will not displace American Workers as the Green Card is awarded to professionals who are allready here and working for last 6 years or more.

    - Most importantly it will retain American competitiveness by retaining the experienced professionals who will otherwise go back because of the very long wait for their Green Card approval.

    I would love to get a free lunch but facts are facts. I will not argue with you or about you but when and if you can refute ANY of the following statements, do write back and we can have a healthy discussion on this forum:
    1. Why does Walmart/Gas station charge me money? I pay for a service or product I want which they give and have irrefutable proof that they gave. IV has no such proof of anything it has done for anybody individually or as a group on this forum.
    2. You buy bandwidth and free lunch by donating?? NO. Do you see that big ad for a lawyer splashed on every page? That is what pays for the bandwidth. Many "non-donors" answering questions for each other in this forum or just by the act of engaging in fruitless discussions with you is what is paying for the bandwidth.
    3. You seem to be under the impression that IV got the visa-bulletin reversed??? Moses, wake up and smell the roses. The massive class-action lawsuit being pursued by AILA, the Silicon Valley lobby pressuring Zoe Lofgren, almost all immigration lawyers asking people to join the class action .. what about all of that? Do think your 25 bucks on the flower campaign is what got the bulletin reversed?
    SERIOUSLY??

    And there were some comments about "if you dont want to contribute, get the heck out of here".... Can you explain to me how this is any different from "If you dont agree with me, dont talk to me?"

    Why is dissent from the popular ideology of "IV is our saviour" treated with such disdain?

    I just said that "IN MY OPINION (which is mine and only mine and I dont speak for anyone else) I dont think IV is doing anything". People who think IV is doing something are most welcome to put their money where their mouth is....But the problem arises when IV pretends to represent the "Immigrant Community" but then turns back and says Well, there are 2 kinds of immigrants, the kind that give money to us and the kind who dont....See where i am going with that? Do try to think about the possibility (and i am only saying possibility) that you might be wrong and the one with the different viewpoint might have some merit to the discussion?

    History? your I-485 was applied on 2nd July, 2007. Do u know the history of why u'r AOS was not thrown out the window because CIS reversed the visa bulletin? Who cares, as long as you are in the queue and others are paying for your free lunch.

    Frists Bill talks about advanced degree. So if u are in EB3 with an engineering degree from say India/China, does it cover such EB3 candidates ? Is his bill beneficial to only EB2 and above ?????!!!!!
