Thanks to the glorious service of the Atlanta center :mad: I missed the I-485 bus by 7 days( Labor cleared on Aug end ). Many people with later PD's got cleared from the Chicago PERM center . Now I just watch as all members get their EAD's and AP's while I wait with nothing but hope and watch legislation after legislation fail in the senate and house , and the letters flying all over the place .
I remember my past by reading your sad story. Though I had different cause for my tragedy. In Year 2000 November my then employer filed RIR labor and I got approval in January 12th 2001 and Same day HR filed my I-140. On January 22nd during companywide mass lay off I was slashed.. Again go through one more lay off in year 2002 with different employer and still waiting for GC(After filing 4th application in year 2003, Rotting in PBEC for almost 4 years)... Best Luck to you.

why? because there is nothing negative to say.
on the contrary, many people are discovering that their misperceptions aboutu legal immigs are wrong, and that before CIR the legal system needs to be fixed first.
I agree that our tone should not be negative, maybe not call it a boycott, but show them that we are protesting in a big and united way.
We have to differentiate ourselves from the illegals. Let the illegals do Rallies, Huger strikes etc.

Thats exactly what I asked. How come your dates are current? Is your PD 2005? Just curious because if your LC was obtained recently, how could your PD be so early to become current? Now this is only a problem for countries like Indian and China. For the rest of the world everything is current I guess. Good for you anyway.

Hey guys,
My name is Debasish and I live in Santa Monica near UCLA. I think we all should get together and do something to mobilize our chapter here in So-Cal area. We all know that there are a lot of people who are on H1B and have applied for their GC. But they are waiting....
For myself, I have applied for my GC and still waiting for the I-140. Don't know what they are doing in the TSC???
So the idea should be to get them invloved...Somebody has rightly put it that we do not have a collective voice and that's why we are ignored...

We applied in Nebraska in August 2003, Cleared in State on August 29th 2003, Transferred to Chicago DOL on Sept 1st 2003..Got Certfied on Oct 16th 2003...So yes..in some states Labor was VERY Quick.

I think there are many ways to look at it. Doing Free service , yes it is a form of Gandhigiri, but will that cause the lawmakers to recognize us and pass laws in favor o fus..I do not think so.
I think our situation is no different than people in South Africa in Gandhian times. How Gandhi fought for them is by writing and writing and pestering the Authorities to reduce unfair taxes on Indians in SA and to solve other problems they had like cannot ride in the same Trains/cars as Whites etc...., fighting for their rights in a Vocal but Non Voilent - non aggressive approach.
We, in this post , have equated Gandhigiri with - divide ur attention - Go Do MBA- be occupied with something else while u are retrogressed, furthur ur career/skills,,,etc I do not think that is what Gandhigiri is about i.e. doing something for the self, but instead do it for the community. In this case IV is our community and its leaders are doing the right thing for our cause and if we continue to support that by adding members, funds we will do a fair bit of gandhigiri towards our cause.

H1B believe it or not is a "dual intent visa". F1 is NOT a dual intent visa. So what that means is even tho a person entered USA on H1B(which is Nonimmigrant visa) he can have a dual intent to "adjust status" and become a permanent resident.
So I would think it would very wise to be given a PD based on when a person started working on "H"
Coming in through H1 does'nt show your intention of becoming a permanent resident of this country. It only happens when the LC is applied. Although the entry date is an ingenious way, it will only create more issues. Now some one who comes in F1 can also ask for the same benefit when they move to H1, to take their entry date in F1 as their priority date. I believe the culprits are the labor substitution and the labor certification sales. Those are unfair. Stop labor substitutions, and if they need one, then use the 140 RD as the PD. That should solve most of the problems and people from using labor sub to jump the line.

I agree. All this Gandhigiri is not going to do anything. Guys lets just stick with lobbying and reduce what we ask for like I mentioned on another thread. As long as everyone gets SOME benefit we should be good.
Too much of these fasts and rallies is going to do just one thing, it will send a powerful message of the WRONG kind to the American people that "First they come on temporary work visas, then they forcefully demand Permanent residency". It will affect us even more when we go back for visa interviews and also new people coming here will have problems. Also, unfortunate but true, IV is still viewed as an organization For the Indians, By the Indians, even though this is Not true at all. If you add the whole Gandhigiri aspect to it, it will only add more fuel to the hate fire that most anti-immigrants now have against some of us Indians.
By all means let us send a card every week to the Senators and Congressmen asking for help. A nice personalized card to each one of them EVERY week. Other than that let us PLEASE not entertain thoughts of "non-co-operation" and "Hunger Strikes". Let us remember Gandhiji was fighting to get OUR OWN country back from the FOREIGN British Rule. Revenue = 750K*200 = 150 million dollars.
For that kind of money they should be able to hire more than 30 personnel I think.

H1Bs taken care by California and Vermont centers. 485, 131 and 765 are handled by Nebraska and Texas centers.
Also, Nebraska is big and main center. They know how to handle load.
Here are the EAD statistics (real numbers):

By seeing above numbers, you can see how USCIS handles load of millions of EAD applications every year. so, 600K is not a surprise for them. In 2003, they got more 2 million applications, but they handled well. But it may be take one or two months extra, i.e. 3+2 = 5 months maximum to get your EAD. Thats for sure. They will be prepared for that when you they allow us to file.
If you already applied for EAD now, then you will for sure have a EAD by December.
