I am already in the porting phase. My EB2 labor is in process. I just hate to see those still in EB3 hoping their day will come. They need to port their applications right away, or those with recent filings using fake experience will be ahead of them coz EB2 gets processed first with all the spill over.
And I would rather help them than someone like you who would not even disclose your info. You are a clear example of someone trying to walk the walk of the illegal aliens.
And what makes you think it is silly socialist? Unless you are one of the new graduates with a bachelor's degree with 5 years of experience on your resume.
My bad.. I misread your post. Your words sounded as if you were complaining about ethical reasons and not porting even if you were eligible to do so. It looks like you are the right thing already by porting.

Hey guys
Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

If your employer revoked I-140 after 180 days of filing 485 and you did work for the employer who filed 140 for 180 days after filing 485 you will win with USCIS. Wait for the denial notice to find the reason, then file for Motion to reopen with your lawyer's help.
Your employer should not have revoked 140 (bummer) and if he did it after 180 days it cant be the reason for denial unless someone at USCIS just did the job in their usual way (read they dont read rules which they should follow day to day)

But don't you need the original LC approval notice for concurrent filing? It was already included in the I140 filed on July 17. I will just hope and pray that I can receive the receipt notice (or at least receipt number) before August 14~15. Thank you, SVAM77!

Guys who are frustrated..i totally commiserate with all of you who are stuck in BEC..All the july filers would be eligible to file for their 485s and would get their EAD's ad AP's a couple of months earlier than the folks stuck in BEC.The BEC folks would get them too when the dates move starting Oct 1st.
Its ultimately the PD thats important for the green card..since you already have your PD much before than the june fliers,you always have your place in the GC line. Unless you guys come and join us its not gonna move...

USCIS reps did not mention any specific group to me. But what I was told was that, everyone's information should be in the USCIS system by August 1st. So urs would be too.

The initiative and effort you and other administrators doing at Immigration voice is commendable. As I have taken up new job only recently i am not able to make it for the advocacy day at Washington. I guess we all have problems with USCIS, either with their inefficiency (eg. receipt delays during July Fiasco), or sometime with their super efficiency (EAD's getting approved too fast):D
That's true. It was observation that paper based filing taking 25 days and e-filing taking 50 days.
Still 10 days to receive mails. We may have several such cases.

Alias, very helpful guidance. I plan to take this up with my attorney and see if I can correct the error. Can you let me know which attorney firm worked for you? It feels frustrating that now I need to spend money on an attorney and go through all the stress for correcting the mistake probably made by a USCIS staff.
To the question from urwelcome, I don't think I received a I-485 approval notice. As far as I know, I had the biometrics, then an RFE and then a Welcome Notice in January. I have never received the actual card as in the case of Alias and my spouse's status remains unchanged. I am on EB3 (India) and the PD is August 2003.( don't have the exact date on top of my mind, it has been a long time:-))

I was never able to figure out why this senthil visits this site. He will be at home on numbersusa or any anti eb websites. I think he comes here to torture us. The bottomline in his posts seems to be all eb immigrants should drop dead and that will be the solution to all problems. Please senthil why dont you go elsewhere, for once after a long long wait people are a bit happy because of 485 filing please dont spoil it with your anti-eb and anti h1b rhetoric.

How you can impress Senate or house? But anti immigrants gave all the layoff numbers, h1b numbers used and details of abuses happened for past few years. It is not just money power will win. With facts and numbers if you have money power then you can win. That is reason for past 3 years H1b numbers or GC numbers were not increased inspite of heavy lobbying.

I applied for tax return with my cousin as dependent. I am H1B on a project working for MNC, spouse in H4 and my cousin is doing his MS on F1. Since my wife has only ITIN, my understanding is that there is NO stimulus payment for me and my cousin will loose his $300 as he is claimed as dependent. last week, my cousin got a letter from dept of treasury that his stimulus payment is on the way and sure enough, couple of days later, a check for $300 is waiting for him.
Is this normal that a person with a SSN who filed his return as dependent get stimulus benefit? just checking if anyone else got one like this.. does this mean I can expect $300 for myself being on H1B with SSN also?

I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?

Does anyone know the process of how USCIS updates 485 application, once 140 gets approved after 485 is filed (considering one files 485 with 140 pending receipt)?
